What it does & where it stands

SB1294 updates how condominiums and planned communities run elections and ballot measures. It lets associations offer online voting as an alternative to absentee ballots, tightens how voter identification must be attached to a ballot, and sets a firm one-year window for challenging an election. It also extends how long ballots and voting records must be kept.

For homeowners: Pro-homeowner: it preserves the secret ballot and a guaranteed absentee/in-person option even where online voting is offered, and gives owners a clear one-year window to challenge a flawed election, forcing a repeat on a substantive violation. Extended ballot and record retention makes results verifiable after the fact.

Key provisions

What the bill actually does, point by point — from the Arizona Legislature’s official fact sheet.

  1. Allows an association to authorize an online voting system (under A.R.S. 10-3708) in place of absentee ballots, but the association must give notice that any owner can still request an in-person or absentee ballot.
  2. Requires the completed ballot to be accompanied by a separate identification document, or the sealed envelope holding the ballot to carry the voter's identification, rather than putting the ID inside with the ballot itself.
  3. Sets a one-year deadline: any owner may challenge the validity of an election or ballot measure within one year, and if a substantive violation is found the election must be repeated.
  4. Requires completed ballots, voter ID documents, written consents, online voting system reports, and signed envelopes to be retained for at least one year after the election.
  5. Applies the same rules to both condominiums (33-1250) and planned communities (33-1812).
