This bill sets requirements for an association's annual membership meeting — notice, timing, and access — the meeting where owners vote and hold the board accountable.
In short: Sets requirements for an association's annual membership meeting.
Introduced — no action Mixed
SB1384 standardizes how condominium and planned community elections and ballots are conducted. It bans cumulative voting and floor nominations, requires all eligible candidates to appear on the ballot, sets a low 10 percent quorum default, and requires ballots to state the quorum and approval percentages needed. It also sets ballot delivery timing and record retention rules.
For homeowners: Mixed: ballot-clarity gains (stated quorum/approval thresholds, every eligible candidate on the ballot, a 10-day delivery minimum) help owners, but the bill also bans cumulative voting, a minority-owner protection that lets a small bloc elect one director, and sets a low 10% quorum default that lets decisions pass with minimal participation. The transparency upsides roughly offset the board-friendly voting mechanics, so the net is genuinely two-sided.
What the bill actually does, point by point — from the Arizona Legislature’s official fact sheet.
- Prohibits cumulative voting and prohibits nominations from the floor; all eligible nominated candidates must appear on the ballot, which may include write-in lines equal to the number of positions.
- Sets a quorum of one-tenth (10 percent) of the total votes entitled to be cast for annual meetings and director elections, unless the governing documents specify a lesser amount.
- Requires ballots to state the required quorum for each proposed action and the percentage of approval needed for each action other than the election of directors.
- Requires associations to deliver ballots to eligible voters not later than ten days before the deadline.
- Makes each ballot valid for only one specified election or meeting of the members.
- Allows delivery by mail, in-person, or electronically (email, fax, or an online voting system).
- Requires voting materials to be retained in electronic or paper format and available for inspection for at least one year.
